    OTF Legal Eagles: Urgent help required

    Help me. I've been lifted for the murder of Maddie McCann.

    Not really.

    My girlfriend's little sister, Michaela, is pregnant. She's due to drop her sprog on December 13th, and as a result, has suspended her university course for a year.

    This, according to the Job Centre, means she cannot apply for job seeker's allowance. She also doesn't qualify for incapacity benefit as she hasn't paid enough National Insurance. She also can't qualify for a maternity grant as she doesn't claim income support. They did give her £75 a week ago, but now are asking for it back, as it was a mistake.

    So she went to the university, who suggested she applies for a grant, and also her loan for the year. Which is fair enough, and solid advice. However, the LEA are now saying she doesn't qualify as she isn't a student. Which they should perhaps tell the folks at the Job Centre.

    We're at a bit of a loss where to go from here. She has no money whatsoever, and can't even buy food until she has the kid, at which point her circumstances change. Apparently. We've got a pile of letters from everyone, that basically talk themselves in circles, saying they can't do A until we do B, but we're not qualified for B until A is done.

    Can anyone point us in the right direction - hell, any direction - where to go with this. Michaela can do without this stress (obviously) and is very down about it, and reluctant to get help from her family, who aren't in a great position to help anyway.

    Also, if you anyone knows how to get two free tickets to that Monkey thing at the 02, that'd be nice. But not essential.

    I think the crucial part of this might be "she doesn't claim income support". Why not? Is she not entitled? It's not automatic that everyone "out of work" deserves a penny, you know, what do think this is, a state run by a socialist administration proud of its "safety net" heritage?

    Seriously, though, the welfare state will not leave a prospective mother penniless. For God's sake get back on to the DWP and work out what she can claim, and how, and crucially how soon.

      Because she's classed as a student by the Job Centre. But her LEA class her as not. As I wrote. Albeit badly, it seems.

        Maybe a visit to her MPs office will get a few phones ringing and sort it out. Obviously I don't know the regional politics, but usually there's some kind of elected bod you can appeal to at the local level in times of intractable bureaucracy.

          We've spoken to our MP, and she's written a letter to the Job Centre asking for clarification.

                This might be a good place to look, and making an appointment at your local CAB would be a good idea. Good luck.
