The "reclassification" arises from the prosecutors' decision to accept his guilty plea to rape in the third degree rather than try him on the more serious second degree charge and the related child welfare charges.

An explanation of the different degrees is here.

That type of deal is how the vast majority of criminal cases are disposed of in the US system. The reduction in the number and severity of the charges is very common, and the reason such deals are called "plea bargains".

As I noted above, the reduction in degree was crucial to the outcome, as rape in the second degree carries a mandatory minimum sentence, while the charge he pled to does not.

At least in New York, statutory rape is reserved for cases in which the underage victim has consented to the act (though that consent is not legally valid). That doesn't look to have been the case here.
Thanks for this. That link suggests, however, that third-degree rape should carry a sentence of 'up to four years in prison'. (This number must include 'zero', then.)

I'm just stunned that such a serious offence can be open to plea-bargaining in this way.

Welcome to America. Capital murder cases frequently are resolved through plea bargaining (most often with the prosecution agreeing not to seek the death penalty).

In this context, "up to" indicates the maximum possible sentence (and the absence of a mandatory minimum, which both of the other degrees have).

Third Degree Rape: Class E felony (up to 4 yrs. in prison and up to $5,000 in fines)

Second Degree Rape: Class D felony (1 to 7 years in prison and up to $5,000 in fines)

First Degree Rape: Class B felony (5 to 25 yrs. in prison and up to $5,000 in fines)

He just loved to live that way, and loved to steal your money.

Desperate news that he then went on to hurt people.

He murdered his mother and two brothers - and nearly a third - so his fiancé wouldn't learn that he was unemployed.

I read that article about the crossbow murderer, and all I could think of was this.

                            Did we miss this?

were the Philippines really about to declare war on Canada over domestic refuse being mislabelled as plastic recycling?

That was an embarrassment. We've had 'lots of really smart people' working 'hard' for a 'very long time' to get a few dozen shipping containers returned from the Philippines? Really? The best minds of our generation couldn't crack this? Should have put one of the dollar-store franchises on the case. They can get 100,000 shipping containers of garbage to Canada from Asia in about 6 weeks.

                                    4 times 17 is only 68.

The family is clearly slacking off.

It's not even that is it? Mother at 23, grandmother at 46, great-grandmother at 69 would do it.

Quite. Normally I despise large companies who claim ownership of words and bully other businesses (usually innocent small businesses) by means of legal threats if they dare to use the same words (usually with no serious possibility of any meaningful confusion or goodwill-stealing). But on this one occasion only, I think Nestle ought to sue them for trademark infringement. Not because there's any risk of confusion with the chocolate bar, but just because that abbreviation for Yorkshire pudding is so twattish it deserves to be heavily penalised. Alternatively, the nachos-in-Yorkshire-pud vendors ought to have to market it as "Yorkie - a real dog of a dish".
