    I still don't understand how this sort of thing, and the whole "surprise, your anaesthetist was out of network" scam, don't fall under fraudulent misrepresentation.

      I doubt she can afford a lawyer to fight them, but it sounds like she'd have a good case.

      This is typical. As I've mentioned before, the only emergency room in my area is out of network.

      The US health care "system" is a fucking disgrace and anyone who is fighting to keep things the way they are is killing people.

        Various legal immunities can come into play when one is dealing with hospitals, though the usual defence is that there was never an explicit representation that the patient was covered/the specialist was in network, etc.

        There is also a very obvious disparity of resources to fight this kind of thing, and the differences among cases are enough to defeat class certification.

          I've read about multiple cases where the patient explicitly asked, and was assured, that the treatment would be covered/in network.

            By someone who turns out not to have authority to bind the hospital/network

            There are definitely elements of a defence there, but the general idea of these claims is to terrorise the patient and wear them down.

                  At least in the cases I'm thinking of, the patients are induced to sign (indeed refused to sign until they were made) by the representations .

                    There may indeed be cases like that, but they are by no means common.

                    And I would beware of press reports that rely entirely on the allegations of plaintiffs' attorneys.

                      The objection is to where the charity is feeding them. There's been a huge increase in rough sleepers in Cardiff centre this year and maybe this sort of row is needed to bring it into more prominence.

                                I have to admit that my main WTF? from that story is the discovery that the Cheesecake Factory is a real restaurant chain, not just something made up by the writers of the Big Bang Theory.

                                      I have dined in one Cheesecake Factory, I've had order-out from one in an emergency, and I actually failed to get into one in Palm Desert because it was jammed to the rafters with very old snowbirds.

                                      The menu feels like it's about the length of War and Peace, trying to offer some version of pretty much every cuisine on earth - there's Mexicanish and Italianish and Thaiish and Chineseish and Frenchish (ish) and Americanish. And I think they have a shepherd's pie and poke bowls, too.

                                      It was spectacularly unsatisfying in all instances.

                                      I've never had their cheesecake.

                                              Not that I've noticed, but you might be right. I think I've seen the odd ice cream parlour around but they seem to mainly cater for kids.

                                                They actually opened one in Queens last year.

                                                Which is much too close for my peace of mind.

                                                Dessert-only establishments are still not a thing, unless one counts ice cream parlours and bakeries/confectioners with seating, like Veniero's, which has been going for over a century.
